MAY DREAM TOURISM TRAVEL AGENCY SERVICE AGREEMENT
I. PARTIES
May Dream Tourism Travel Agency: Hereinafter referred to as "the Agency," with rights and obligations specified below.
Consumer: Referred to as "consumer" in this agreement, with their rights and obligations specified below. The identity details of the consumer are attached to this contract.
II. GENERAL TERMS
- May Dream Travel Agency (the Agency) reserves the right to change hotel names, means of transportation, and departure times specified in the itinerary, provided it remains within the standards specified and with prior notification to the consumer. The sample itineraries provided at registration are indicative. The dates for optional tours mentioned in the programs may be changed at the discretion of the tour guides. The consumer accepts that the terms of the trip are fulfilled as long as the total duration of overnight stays is not reduced and the class and category of the accommodations remain unchanged.
- The price paid for the tour includes all services listed on the tour or hotel reservation voucher. Hotel check-in and check-out dates, durations, transportation details, and board types are also specified on the voucher. Additional tours and services not listed are subject to extra fees. Taxes, duties, fees, and similar payments that must be collected from tourists under the laws of the visited countries, as well as price changes due to currency fluctuations, are passed on to the consumer. These changes are promptly communicated to the consumer, who can then withdraw from the contract without paying any compensation or accept the changes and their impact on the price by agreeing to an additional contract.
- The Agency acts as an intermediary between the consumer and the hotels, transportation companies, and other service providers involved in the tour and is obliged to notify consumers of any changes within 24 hours. The Agency is not responsible for consumers who fail to be present at designated times or locations, delays or malfunctions of land, air, and sea transportation, or obstacles such as fog, storms, or any weather conditions affecting routes and itineraries. The Agency is also not liable for acts of strikes, terrorism, war, or force majeure events, nor for accidents or service disruptions caused by third-party errors or unforeseeable technical issues. Consumers must seek compensation for damages from the primary parties responsible and can only approach the Agency under strict liability principles if compensation from the primary party is inadequate.
- The Agency conveys room requests to the accommodation provider but cannot guarantee fulfillment. Rooms are delivered to consumers at 2:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure.
- According to Article 6 of the Package Tour Contract Regulation, the agreed-upon price and terms cannot be altered. However, changes in port or airport landing taxes and similar fees, along with currency fluctuations affecting the tour price, are exempt from this rule. Any increase in price before the start of the package tour is communicated to the consumer, who can cancel the contract without penalty.
- The Agency is responsible for changes occurring after the start of the tour that negatively impact the consumer. May Dream Tourism Travel Agency may compensate the consumer for significant negative changes either monetarily or by offering equivalent services, in accordance with the provisions of the TÜRSAB Kütahya Scale. The consumer’s right to compensation is void if additional or replacement services have been used or consumed.
- The consumer is responsible for providing accurate names as listed in their passport. In case of discrepancies between the consumer’s and the Agency’s copies of the contract, the Agency’s records prevail.
- Tour participants are entitled to bring two suitcases, each no larger than 50 cm x 70 cm, and up to 20 kg of baggage for air travel. The consumer is responsible for their luggage and its contents.
- Items that are odorous, leaking, flammable, or explosive, as well as any sharp, cutting, or firearms and all types of animals, are not allowed on transportation vehicles or in accommodations without explicit written permission from the Agency.
- Any matters not covered in this agreement are subject to relevant laws, conventions, and regulations, including Law No. 1618, Law No. 4077, Law No. 4288, Law No. 2634, IATA, IHA, UFTAA Convention regulations, the Civil Aviation Law, the Turkish Commercial Code, and the TÜRSAB Kütahya Scale, which is based on the internationally recognized Frankfurter Tabelle.
- All charter flight arrangements are subject to international aviation rules, including the Warsaw Convention, and flight schedules may change. Departure times cannot be guaranteed, and the carrier may modify or omit stopover locations. Flight times are confirmed 48 hours in advance, and any changes will not result in liability for the Agency.
- In case of travel by plane, train, or ship, fare increases are added proportionally to the announced tour price.
- The scope of insurance coverage for consumers who purchase travel insurance is defined by the policy of the insurance company. The Agency is not responsible for any claims related to incomplete or defective performance, damage, or losses covered by the insurance company. Under Article 12 of Law No. 1618, insurance covers the package tour price if the tour is not provided or provided incompletely. Please request your insurance policy from your sales representative.
- If the consumer requests the Agency to handle visa procedures, they must provide a passport valid for at least six months and all necessary documents specified by the consulate, at least one month before the trip. The consumer is responsible for all expenses, and the Agency acts only as an intermediary. If the visa is not granted, the specified cancellation conditions apply. The Agency is not liable for visa rejections or entry refusals.
- Consumers who have not signed the contract but are participating in the tour are considered to have accepted all contract terms by appointing a consumer who signed on their behalf. The terms of the contract are binding even if the consumer did not sign it personally.
- This contract, drawn up in duplicate and signed by authorized representatives of both parties, has been read, checked, and accepted. The person signing on behalf of the consumers named in the contract accepts all legal responsibility.
III. PAYMENTS
- At least 35% of the reservation cost must be paid at registration, with the balance due no later than 10 days before the tour begins. Failure to make these payments results in the cancellation of the reservation, and 35% of the total cost is charged as cancellation compensation.
IV. CANCELLATIONS, CHANGES, TRANSFERS
- The Agency can cancel or change the tour up to 7 days before departure if the minimum number of participants is not met or for other necessary reasons. The consumer is entitled to a full refund.
- If the consumer cancels the tour at least 15 days before departure, a full refund is provided (excluding deposits). For tours involving transportation tickets, cancellation rules of the respective companies apply.
- Cancellations or changes made between 15-7 days before departure are subject to a 35% fee, and cancellations within 7 days of departure require full payment.
- Special or early booking services are refundable up to 60 days before departure. Refund amounts decrease incrementally as departure approaches.
- Cancellation conditions for plane, train, or ship tours adhere to the carrier's terms.
- Consumers failing to pay the full amount within specified periods are charged according to cancellation terms.
- No name changes are allowed for scheduled flights. Consumers are responsible for penalties related to lost tickets.
- Consumers missing the start of a tour must inform the Agency in writing. Otherwise, all reservations are canceled after 24 hours, with no refunds.
- Severe illness or death of the consumer or close relatives is an exception if documented.
- Tours can be transferred to another person 7 days before departure. The transferee and the consumer share responsibility for additional costs.
- The Agency can modify the itinerary, hotels, or transportation arrangements if necessary. Consumers may cancel and receive a refund if they do not accept these changes.
- Charter flight cancellations made within 15 days of departure are non-refundable.
V. DISPUTE RESOLUTION
- Disputes are subject to the TÜRSAB Arbitration Board.
- Legal disputes are settled in İzmir Courts and Enforcement Offices.
